This paper aims to debate the role of Right as an intermediation element in the state-society relationships in Brazil from the contributions of the sociologist Luiz Werneck Vianna. This paper discuss the main concepts used in the construction of his interpretation of Brazilian modernization, without pretension of exhausting the subject. The debate does not deepen the empirical data collected and analyzed is his researches, but seeks to make explicit the main ideas in his thought. Firstly focused on Labor Legislation, that contributions go through many themes and came to problem of judicializing of politics and social relations. The central thesis that goes through the Werneck Vianna’s work is that the non-hegemony of industrial entrepreneur in the Brazilian modernization process elevates the relative weight of the intellectuals, among them the political jurists in first level, in the process of building of Brazilian political and juridical institutions.
